Terms of Use
These Terms of Use ("Terms") govern your use of the MyKiddos application ("MyKiddos", "the App"), published by Paul Badarau, trading as alplustech ("we", "us", "the developer"). By downloading, installing, or using MyKiddos, you agree to these Terms.
1. License and paid app
MyKiddos is a paid application licensed, not sold, to you for personal, non-commercial use in managing health-related records for your own children or children in your care. You may use MyKiddos on devices associated with your Apple ID in accordance with Apple's sharing rules.
2. Apple's Licensed Application End User License Agreement
Your use of MyKiddos is also subject to Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms are silent or where Apple's EULA imposes stricter obligations, Apple's standard EULA governs; where these Terms are more specific to MyKiddos (such as the medical disclaimer and data terms below), these Terms apply in addition to, and not instead of, Apple's EULA.
3. What MyKiddos does and does not do
- MyKiddos records information you choose to enter: temperatures, medicine doses, symptoms, notes, photos, vaccines, and growth measurements.
- Dose reminders are local notifications based solely on the wait time you configure. MyKiddos does not know, calculate, or suggest an appropriate dose or interval for any medication.
- MyKiddos does not connect to any developer-operated server. It is not a substitute for professional medical advice, monitoring equipment, or emergency services.
4. Your data
All information you enter is stored on your device and in your own private iCloud account, as described in our Privacy Policy. You are responsible for the accuracy of the information you enter and for maintaining access to your own Apple ID and iCloud account. You can export your data at any time from within the app.
5. No warranty
MyKiddos is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of defects, or that logged data, reminders, or exports will always be accurate or delivered on time.
6. Limitation of liability
To the maximum extent permitted by applicable law, in no event will the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, health outcomes, or other losses, arising out of or related to your use of, or inability to use, MyKiddos, even if advised of the possibility of such damages. Where liability cannot be excluded under Romanian or EU consumer protection law, our liability is limited to the amount you paid for the App.
7. Termination
You may stop using MyKiddos and delete it at any time. We may update or discontinue features of the App from time to time; where required by applicable law or the App Store, we will provide reasonable notice of material changes.
8. Governing law
These Terms are governed by the laws of Romania and, where applicable, the European Union, without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the competent courts of Romania, except where mandatory consumer-protection law provides otherwise.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where required, note the change in the app's release notes.
